We are Jobfly ("Company," "we," "us," "our"), a service provider operating in Australia. We operate the website https://jobfly.co (the "Site"), and any other related products and services that refer to these legal terms (collectively, the "Services").

Jobfly provides AI-powered tools designed to assist users in drafting and optimizing professional documents, including cover letters, resumes, and interview preparation materials.

These Legal Terms constitute a legally binding agreement between you, whether personally or on behalf of an entity ("you"), and Jobfly. By accessing the Services, you acknowledge that you have read, understood, and agreed to be bound by these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

2. AI Services and User Responsibility

The Services utilize artificial intelligence to generate suggestions and content. You acknowledge and agree that:

• No Guarantee of Outcome: Use of the Services does not guarantee employment, interviews, or any specific career outcome.
• Verification Required:AI-generated content may contain inaccuracies or "hallucinations." You are solely responsible for reviewing, editing, and verifying the accuracy and truthfulness of any document generated by the Services before submitting it to a third party.
• Human-in-the-Loop: The Services are intended as a productivity aid. Final professional judgment remains the responsibility of the user.

3. Intellectual Property Rights

Our Intellectual Property

We own or license all intellectual property rights in our Services, including source code, databases, software, and website designs (the "Content"), as well as trademarks and logos. Our Content is protected by Australian and international copyright and trademark laws.

Your Submissions and Outputs

You retain ownership of the original data you upload to the Services. By using the Services, you grant us a limited license to process your data solely for the purpose of providing the Services to you. We grant you a non-exclusive, non-transferable license to use the AI-generated outputs for your personal, professional use.

4. User Representations

By using the Services, you represent and warrant that: (1) all registration information you submit will be true and accurate; (2) you have the legal capacity to comply with these Legal Terms; (3) you are not a minor in your jurisdiction of residence; (4) you will not use the Services for any illegal purpose; and (5) your use of the Services will not violate any applicable law or regulation, including the Australian Privacy Act 1988 (Cth).

5. Purchases and Subscriptions

All payments shall be processed in Australian Dollars (AUD) unless otherwise specified. Subscriptions automatically renew unless cancelled. You can cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current paid term.

6. Prohibited Activities

You agree not to:

• Use the Services to generate fraudulent, deceptive, or misleading professional documents.
• Attempt to reverse engineer, decompile, or disassemble the AI models or software comprising the Services.
• Use any automated system (bots, scrapers) to access the Services without our prior written consent.
• Upload content that violates the intellectual property rights of third parties.

7. Privacy and Data

Your use of the Services is governed by our Privacy Policy. We comply with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth). By using the Services, you consent to the collection and processing of your data as outlined in said policy.

8. Australian Consumer Law (ACL)

Our Services come with guarantees that cannot be excluded under the Australian Consumer Law. For people in Australia, this means that for major failures with the service, you are entitled to a refund or replacement.

To the extent permitted by law, any other warranties—including implied warranties of merchantability or fitness for a particular purpose—are excluded. Nothing in these Terms is intended to exclude or limit any statutory rights you have under the ACL.

9. Limitations of Liability

To the maximum extent permitted by law, Jobfly shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the Services. Our total liability to you for any cause whatsoever shall be limited to the amount actually paid by you to us for the Services during the twelve (12) months preceding the claim.

10. Governing Law

These Legal Terms and your use of the Services are governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales in any such matter or dispute.
